Terms and Conditions

1. Introduction 

1.1 Welcome to Race And Rally Supplies (Motorsport) LTD ("Company", "we", "our", "us"). These Terms and Conditions ("Terms", "Terms and Conditions") govern your use of our website located at www,racerallysupplies.co.uk (together or individually "Service") operated by Race And Rally Supplies (Motorsport) LTD. 

1.2 Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard, and disclose information that results from your use of our web pages. 

1.3 Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood Agreements and agree to be bound by them. 

1.4 If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at info@racerallysupplies.co.uk so we can try to find a solution. These Terms apply to all visitors, users, and others who wish to access or use Service. 

2. Communications 

By using our Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at unsubscribe@racerallysupplies.co.uk 

3. General  

3.1 "Working day" refers to any day that is not a Saturday, Sunday, public holiday, or bank holiday. 

3.2 These conditions are applicable to all quotations, orders, and cotracts, (including those made via internet, telephone, and/or post) for the supply of goods by sale or otherwise, accepted by us.

3.3 For trade customers any other terms or representations whether implied by law are excluded and are not binding on the company regardless of whether they are made before, during, or after the contract or order.

3.4 Delivery charges are specified in the 'Delivery and Returns' section on every product.

3.5 Estimated delivery times are specified in the 'Delivery and Returns' section on every product. While we strive to deliver goods within the estimated times, delays can occur due to unforeseen circumstances. Race and Rally Supplies are not liable for any delays or failures to deliver within the estimated times. This is a really important note for all customers to understand.

3.6 On the delivery date or the first attempted delivery date, the risk of loss or damage to products passes to the customer.

3.7 All shipments will be dispatched within 48 hours unless otherwise noted. The delivery time is governed by the chosen courier method by you, not us.

3.8 Following the placement of an order and after verifying your card details and stock availability, payment is taken from your chosen payment method. On occasion things go wrong and so if we cannot or are unable to supply the goods to you, we will of course notify you in the most efficient and speedy way as possible.

3.9 Following from being contacted with regards to us not being able to supply you with certain products, you will be given the option to wait for stock or if you have already paid for the products and they are not a special-order item, the customer can ask and receive a full refund. . 

3.10 To prevent unauthorized use of your credit, debit, or chosen charge card, we will validate the personal information supplied by you, the customer when placing the order against appropriate third-party databases.

3.11 Information on the website is for general guidance only. Specifications, weights, measurements, and technical data (including performance details) provided by manufacturers are for reference purposes. Parts or components shown or described are for illustration only and may vary in size, specification, colour, and fitment depending on your vehicle's make and model. Buyers must verify current specifications, colours, weights, and measurements with manufacturers or the company before ordering. Manufacturers may allow tolerances and may change specifications without notice to improve products. The company will try to inform purchasers of any such changes. 

3.12 By accepting these terms and conditions, you consent to such checks as your name, address and other personal information during the order process. We do not perform a credit check against you and so and your credit rating will not be affected, but personal information may be disclosed to a registered Credit Reference Agency. They may keep a record of that information. This is done solely to confirm your identity, not to perform a credit check

3.13 All information provided to a registered Credit Reference Agency will be treated securely and in accordance with the UK Data Protection Act. 

3.14 The company reserves the right to correct any technical or clerical errors in an order without prior notice. Buyers must ensure all order details are correct before submission. The company will not be liable for errors or inaccuracies in the order after delivery unless notified within seven days of receipt of the document containing the error. 

3.15 Although we strive to ensure that all prices on our website are accurate, ultimately, we are only human and errors do occur. We do everything that we can to check and double check all our products.

3.16 Should we find a price error for goods you have ordered; we will inform you ASAP. At this point you can choose to proceed with the order at the correct price or, should you not accept the correct price you can of course cancel the item from the order and we will refund you to the value of the original charge.

3.17 If we attempt to contact you with regards to an ensue with an order that you have made and we cannot contact you or receive no response from you we will act as if the order is deemed cancelled. In these circumstances we will refund the customer a full refund paid on the goods with the exception if the goods are a special-order item.

4. Availability, Errors, and Inaccuracies 

4.1 We're always working to keep our product and service offerings on the Service as fresh as possible. But hey, sometimes things can go a bit wonky – products might end up mispriced, descriptions could be a tad off, or items might not be in stock. And yes, sometimes there's a bit of a lag updating info on the Service or on our ads elsewhere.

We do our best, but we can’t promise that all the details – like prices, pictures, specs, or availability – are 100% perfect all the time. If we spot something that’s off, we might update or fix it without giving anyone a heads-up. Cheers for understanding!

5. Purchases 

If you’d like to buy any product or service through the Service ("Purchase"), we might need you to give us some info related to your Purchase. This could include, but isn’t limited to, your credit or debit card number, the card’s expiry date, your billing address, and where you want your stuff shipped. 

By making a Purchase, you’re telling us (with fingers crossed) that: (i) you’re legally allowed to use whatever card or payment method you’re putting forward; and (ii) the details you’ve shared with us are true, accurate, and all that good stuff. 

To help process payments and get your Purchase sorted, we might use third-party services. By giving us your info, you’re allowing us to share it with these third parties, as outlined in our Privacy Policy

5. Distance Selling Regulations 

Under the UK Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013, you’ve got the right to cancel an order for goods within 14 days – and you don’t even need to give us a reason! The 14-day period starts from the day you (or someone you picked who isn’t the delivery driver) take physical possession of the goods.

If you want to cancel, just let us know with a clear message (like a letter, email, or fax – if you’re into retro tech). There’s a model cancellation form you can use if you fancy, but you don’t have to. To make sure you’re within the deadline, just send your notice before those 14 days are up.

Once you’ve cancelled, we’ll give you back all the payments we’ve received from you, including delivery costs (unless you opted for some fancy delivery option that costs more than our standard one). 

We’ll process your refund pronto and no later than: 

  • 14 days after we’ve got the goods back from you, or 
  • (if sooner) 14 days after you show us proof you’ve returned the goods, or 
  • if no goods were sent, 14 days after we get word that you’ve cancelled.

We’ll refund you the same way you paid us, unless we’ve agreed on something different. Oh, and don’t worry – we won’t sneak in any fees for processing your refund.

Please make sure you send the goods back to Race And Rally Supplies (Motorsport) LTD, following the instructions on the website, as soon as you can. Definitely do it within 14 days of telling us you’re cancelling. If you get the goods in the post before the 14 days are up, you’re good to go.

Just a heads-up: you’ll need to cover the cost of sending the goods back.

6. Contests, Sweepstakes, and Promotions 

If you fancy entering any contests, sweepstakes, or other fun stuff ("Promotions") through our Service, just a heads-up – there may be special rules for those. Make sure you have a look at the specific rules and check out our Privacy Policy too. If there’s ever a clash between the rules for a Promotion and these Terms, the Promotion rules win, hands down.

7. Intellectual Property 

The Service and its original content (excluding what users add), cool features, and nifty functions belong solely to Race And Rally Supplies (Motorsport) LTD and our licensors. The Service is protected by copyright, trademark, and all those other fancy legal bits in the UK and elsewhere. Just a quick note – you can’t use our trademarks or trade dress with any other product or service without getting our written thumbs-up first.

8. Links to Other Websites 

Our Service might sometimes have links to third-party websites or services that aren’t owned or run by Race And Rally Supplies (Motorsport) LTD. 

Just so you know, we don’t have any control over what’s on those sites and we’re not responsible for their content, privacy policies, or how they operate. We can’t make any promises about what these sites offer either – that’s all up to them!

By using these links, you agree that Race And Rally Supplies (Motorsport) LTD isn’t liable, directly or indirectly, for any damage or loss caused or claimed to be caused by using or relying on any content, products, or services you find on these third-party sites. 

We really recommend having a good read through the terms and conditions and privacy policies of any third-party sites or services you check out.

9. Termination

This clause outlines that Race And Rally Supplies may suspend or terminate your account immediately, without prior notice or liability, at their discretion, particularly in the event of a breach of terms. Users who wish to end their use of the service can do so by discontinuing access. Notably, certain terms, such as warranty disclaimers and limitations of liability, will survive termination.

10. Indemnification

Race And Rally Supplies limits liability in line with applicable law and does not exclude liabilities for death or injury due to negligence or fraudulent misrepresentation. They aim to ensure accurate site information but cannot guarantee timeliness, error-free functioning, or that the site is free of viruses. They are also not liable for any loss of content transmitted via the site or for losses due to reliance on site materials.

In addition, except where expressly stated, all warranties (express or implied) are excluded as much as permitted by law. The company is not liable for economic losses (e.g., revenue, profit loss), goodwill or reputation damage, or special/indirect losses. Their liability for any loss or damage related to products is capped at the payment amount for the product(s) in question.

These terms do not affect your statutory consumer rights or rights under Distance Selling Regulations.

  4. Compatibility and Refunds: Orders incompatible with modified vehicles may be accepted for return at the company's discretion, with exceptions for specially ordered items.
  5. Defective Goods: Defective goods must be returned for inspection before any replacements are considered. Buyers must notify the seller before contacting third parties or incurring related costs.
  6. Competition Goods: Acknowledging that competition goods are for extreme conditions, no claims will be entertained for wear or failure in such contexts. No liability is accepted for losses such as competition points, entry fees, or awards.
  7. Modifications and Liability: Race and Rally Supplies disclaims responsibility for failures arising from unauthorized component modifications or installations. Additionally, liability is not assumed for interruptions or failures due to factors beyond their control (e.g., strikes, civil unrest).
  8. Third-Party Rights: No third-party rights are conferred unless specified, such as enforcing benefits or exclusions from liability outlined in these terms.
  9. Waivers and Entire Agreement: Delays or non-enforcement of rights do not constitute a waiver unless documented in writing. These terms represent the entire agreement between you and Race and Rally Supplies, superseding prior arrangements

12. Disclaimer 

  1. Service at Your Own Risk: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Race And Rally Supplies disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or performance.
  2. No Guarantees for Service Performance: Race And Rally Supplies makes no warranties regarding the uninterrupted availability, security, or functionality of the Service. There is also no guarantee that errors or defects will be corrected, that the Service is free from harmful components, or that it will meet your requirements.
  3. Governing Law: The Terms will be governed by the laws of the United Kingdom. Any legal disputes will be handled in accordance with UK law, and the failure to enforce a provision does not waive those rights. If any part of the Terms is found invalid, the remainder of the Terms will still apply.
  4. Changes to the Service: Race And Rally Supplies reserves the right to withdraw, amend, or restrict access to the Service at any time, without prior notice. The company will not be held liable for any service unavailability or interruptions.

These provisions ensure that the user understands the limitations of the service and the company's rights to alter or discontinue it as needed.

13. Title and Delivery

  • Ownership Transfer: Ownership of goods only transfers to the buyer once full payment has been received. The company may apportion payments if there are outstanding amounts.
  • Delivery Times: Delivery times are approximate. If the buyer wishes to make time of delivery essential, they must provide 20 days' written notice, starting from the last quoted delivery time.
  • Risk of Loss: Risk passes to the buyer once the goods are delivered to the buyer or an independent contractor acting on the buyer's behalf.
  • Shortages or Missed deliveries: Any discrepancies such as shortages or damages must be reported to the company in writing within seven days. Claims for damages must be made directly to the carrier if delivered by an independent contractor.
  • Delivery Charges: Delivery and packing prices are subject to change and will be confirmed at the time of order. International buyers will be provided with approximate costs prior to order confirmation.

14. Cancellation of Orders and Liability

  • Quotation Validity: Quotations are valid for 30 days unless withdrawn or altered.
  • Contract Formation: A contract is formed when the company acknowledges the order or delivers the goods. The buyer is responsible for ensuring that their order terms are complete and accurate.
  • Representations: Buyers acknowledge they will not rely on representations made outside of the company's official packaging or promotional literature.
  • Cancellation Rights: Subject to distance selling regulations, the buyer may not cancel an order once accepted unless under specific conditions.
  • Variation of Terms: Any variations to these terms require written agreement signed by both the buyer and an authorized company representative.

15. Your Right to Cancel Goods Ordered

  • Consumer Cancellation: Consumers in the UK have the right to cancel contracts for goods ordered through distance communication within 14 working days of delivery.
  • Consumer Rights Act 2015: Consumers have the right to reject goods that are unsatisfactory, unfit for purpose, or not as described within 30 days for a full refund.
  • Special Order Goods: These cannot be returned under this clause.
  • Return Process: To cancel, the buyer must provide written notice and return the goods in their original packaging, unused, and with all seals intact, at their own expense. If not returned within 14 days, the company may collect the goods and charge for the collection.
  • Refunds: The company will refund monies within 30 days, subject to any set-offs for outstanding payments.

16. Goods Not Returnable for Credit

Certain goods cannot be returned for credit, including:

  • Specially ordered goods
  • Electrical, glass, hazardous, or explosive parts (if seals are broken or packaging is damaged)
  • Used or fitted goods
  • Promotional or campaign items
  • Other goods as identified by the company or its agents.

These terms help clarify the buyer's responsibilities for ownership, delivery expectations, cancellation rights, and goods return policies, especially in terms of non-returnable or special-order items.

17. Jurisdiction

  • Governing Law: These terms and any related agreements, including those made through distance communication, are governed by English law and industry custom and practice.
  • Dispute Resolution: Any disputes arising from these terms will be exclusively handled by the English and Welsh courts, which have sole jurisdiction.
  • Language: English is the only language offered for concluding the contract.
  • No Partnership: The agreement does not establish a partnership or joint venture between the buyer and Race and Rally Supplies. Neither party can bind the other or act as an agent for the other.

18. Amendments to Terms

  • Right to Amend: Race and Rally Supplies reserves the right to amend these terms at any time by posting the updated terms on the website.
  • Responsibility for Review: It is the buyer’s responsibility to review these terms periodically.
  • Continued Use: By continuing to use the platform after revised terms are posted, the buyer agrees to be bound by the updated terms.

These clauses clarify the legal framework under which the terms are governed and how amendments to these terms will be communicated and accepted.

19. Acts of God and other such

Race and Rally Supplies (Motorsport) LTD shall not be held liable for any failure or delay in fulfilling its obligations under these terms and conditions if such failure or delay is caused by circumstances beyond its reasonable control, including, but not limited to, acts of God (such as natural disasters, weather conditions, or pandemics), alien invasions, or zombie attacks.

In the event of such an occurrence, Race and Rally Supplies will make all reasonable efforts to mitigate the impact on its services. However, no liability will be accepted for any disruption, delay, or failure of delivery resulting from such extraordinary events, and the company will not be responsible for any losses or damages arising from these events.

The customer acknowledges that these events are unforeseeable, and Race and Rally Supplies reserves the right to adjust delivery times or suspend services temporarily, as necessary, until the situation is resolved.
